SpaceX said this week it will keep running the unpermitted gas turbines powering xAI's Colossus data center campus near Memphis for roughly another year, even as it builds a permanent, 1.2-gigawatt natural gas plant intended to eventually take over the site's power load. The company is currently operating 69 turbines at the site, several of which have been running for months without the local air permits regulators say the facility needs.
Colossus was built at extraordinary speed to give xAI enough compute to train and run its Grok models, and the turbines were installed as a stopgap to get power online faster than the local grid or a permitted plant could deliver it. That speed is exactly what's now generating legal exposure: the NAACP and the Southern Environmental Law Center have both sued xAI, arguing the unpermitted turbines are polluting a majority-Black neighborhood in south Memphis without the environmental review the law requires.
The timing matters beyond Memphis. SpaceX's all-stock acquisition of xAI closed five months ago, which means the regulatory and reputational exposure from how Colossus was built now sits on SpaceX's own balance sheet and public-company disclosures, not just on a private AI lab's. Memphis has become something of a bellwether for the AI industry's broader energy problem -- Meta, Microsoft and Amazon are all racing to secure power for their own data center buildouts, and none of them have fully solved the problem of getting gigawatt-scale power online on an AI lab's timeline rather than a utility's.
Sixty-nine turbines running for months is roughly the generating capacity of a small regional utility, which is the scale of the numbers now underpinning both the lawsuits' claims and SpaceX's own defense that the turbines are a temporary bridge, not a permanent solution.
What to watch: how the NAACP and SELC lawsuits proceed through Tennessee courts, whether the July 2027 timeline for the permanent plant holds or slips further, and whether other AI labs racing to build gigawatt-scale data centers face similar environmental-permitting exposure as they cut the same corners on speed.
